Welcome to SK COSM. These Terms & Conditions (“Terms”) govern your access to and use of sk-cosm.com (the “Site”) and any purchases made through the Site.

The Site is operated by SK COSM LIMITED, trading as SK COSM (“SK COSM,” “we,” “us,” or “our”).

By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms, our Privacy Policy, Refund & Returns Policy, and any other policies referenced on the Site.

If you do not agree with these Terms, please do not use the Site or place an order.

2. Eligibility

SK COSM is an international online retailer of Korean cosmetics and skincare products.

Products available through the Site are offered for international sale and shipment.

We do not currently offer domestic sales or delivery within South Korea through this Site.

Availability of products, payment methods, shipping methods, and delivery destinations may vary by country.

We reserve the right to restrict sales or shipping to particular countries, regions, customers, or addresses where reasonably necessary for legal, regulatory, logistical, payment, fraud-prevention, or business reasons.

4. Products

5. Product Availability

All products are subject to availability.

Adding a product to your shopping cart does not reserve that product.

In rare circumstances, a product may become unavailable after an order has been submitted.

From time to time, SK COSM may offer promotional prices, discount codes, quantity discounts, gifts, free shipping, or other promotional offers.

Unless otherwise stated:

• Discount codes must be applied before completing checkout;

Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

Where tracking is available, customers are responsible for monitoring shipment progress and responding to reasonable requests from the courier or customs authorities.

Tracking information provided by a courier may occasionally be delayed or inaccurate.

A temporary lack of tracking updates does not necessarily mean that a shipment has been lost.

We may investigate the shipment with the courier before issuing a replacement or refund.

Unless otherwise agreed with SK COSM, products purchased through the standard retail checkout are intended for personal or ordinary commercial purchasing purposes consistent with the quantities offered through the Site.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer protection law.

38. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, liabilities, or reasonable costs arising directly from your unlawful use of the Site, fraudulent conduct, or material violation of these Terms.

This provision does not apply to the extent prohibited by applicable consumer protection law.

Subject to any mandatory rights you may have under applicable consumer law, disputes arising from these Terms, the Site, or purchases made through the Site shall be subject to the jurisdiction of the courts of the Hong Kong Special Administrative Region.

Nothing in this section prevents a consumer from exercising rights before another court or authority where applicable law gives the consumer a mandatory right to do so.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or, where necessary, severed from these Terms.

The remaining provisions will continue in effect.

43. No Waiver

If SK COSM does not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce that provision later.

These Terms, together with our Privacy Policy, Refund & Returns Policy, and other policies expressly incorporated by reference, constitute the agreement between you and SK COSM regarding your use of the Site and purchases through the Site, subject to any additional terms expressly agreed between us.

We may update these Terms from time to time to reflect changes in our business, Site, services, policies, technology, or applicable law.
